Prenuptial Agreements
A prenuptial agreement is not a plan for divorce. It is a plan for your marriage. A well-drafted prenup gives both parties clarity on how finances will be handled throughout the marriage and provides a clear framework in the event the marriage ends, whether by divorce or by death.
Florida law requires that prenuptial agreements be entered into voluntarily, with financial disclosure, and without coercion. An enforceable prenup can protect pre-marital assets, define how marital property is characterized, address alimony terms, and include other provisions unique to your situation.
The most important thing to know about prenups: timing matters. A prenup signed days before the wedding raises enforceability concerns. Starting the process early allows both parties time to review, negotiate, and sign without pressure.

The Prenup Roadmap
Initial Draft
TFL prepares an initial draft or reviews the draft provided by the other party's attorney.
Initial Disclosure
Both parties exchange financial disclosure so the agreement is built on a clear picture of each person's finances.
Review Meeting
We meet to walk through the draft, answer questions, and address any concerns.
Revisions
We finalize the draft and incorporate any agreed-upon changes.
Send to Other Party
The final draft is sent to the other party and their attorney for review and negotiation.
Negotiation
Attorneys negotiate on behalf of their clients until both parties reach agreement.
Signing Ceremony
Both parties sign before a notary, two witnesses, and a court reporter. Attorneys ask questions to confirm each party understands what they are signing.
Safekeep Your Agreement
Store your prenup in a safe location. TFL will not retain originals.
