Postnuptial Agreements

A postnuptial agreement is entered into after a couple is already married. Like a prenup, it addresses how assets and liabilities are characterized and distributed, but it does so from within the marriage rather than before it begins.

Postnups are pursued for a variety of reasons: one spouse is starting a business and wants to protect their partner from potential liability, the couple did not enter a prenup and wants to clarify expectations, or a significant change in financial circumstances makes it prudent to formalize how assets are held.

What a Postnup Can Address

  • How pre-marital assets are treated going forward
  • Assets and liabilities acquired during the marriage
  • Business interests, inheritances, and individual investments
  • Alimony provisions in the event of divorce or death
  • Any other terms and conditions the parties wish to formalize

Key Difference from Prenups

Because postnuptial agreements are entered into during a marriage, Florida courts apply a heightened standard of scrutiny. The agreement must reflect full financial disclosure and arms-length negotiation. TFL guides clients through this process with the thoroughness it requires.
